General Terms and Conditions (GTC) for Samyna – Tour & Travel Status: 04.08.2024.
The following General Terms and Conditions (GTC) govern the use of the services of Samyna – Tour & Travel, which offers and arranges tours and boat rentals. By using the website and booking tours or boat rentals, you agree to these terms and conditions.
1. Booking and Conclusion of Contract:
1.1 The booking of tours or rentals can be made online via the www.samyna.com website, Instagram, or by email. 1.2 The contract between the customer and Samyna – Tour & Travel is concluded when Samyna – Tour & Travel accepts the booking. Acceptance is made by confirmation by email or in writing. 1.3 The invoice amount must be received on time; otherwise, the tour and the place cannot be reserved. 1.4 An invoice will be sent to you once payment for the booked tour or product hire has been received in full and finalized.
2. Prices and Terms of Payment:
2.1 The prices for tours and product hire are published on the www.samyna.com website and are quoted in USD. 2.2 Payment is preferably made online via the payment methods offered on the website, e.g., PayPal (with buyer protection), direct bank transfer.
3. Cancellations and Changes:
3.1 Cancellations must be made in writing by email to info@samyna.com. 3.2 For cancellations, a distinction is made between tours and boat hire:
- For tours, no cancellation fee will be charged up to 24 hours before the agreed date with the exception of the PayPal fee. For other kinds of transactions, no fee is charged. If you cancel less than 24 hours before the start of the experience, the amount you have paid will not be refunded. We can issue you a voucher that you can redeem for any tour. However, this voucher can amount to a maximum of 20 USD.
- For the Orang Utan trip, if you cancel after 48h and before 24h, a 15% fee of your booking price will be charged with the exception of the PayPal fee. Here, the PayPal fees are deducted from the transaction and the remaining amount is transferred. We can issue you a voucher that you can redeem for any tour. However, this voucher can amount to a maximum of 20 USD. For other kinds of transactions, no fee is charged. The rest payment will be returned. Less than 24h, no refund of the booking price.
- For boats, the PayPal buyer protection fee is non-refundable. The remaining amount will be refunded if you cancel 14 days before departure. For cancellations 13 – 7 days before the departure date, 30% of the booking price is charged. Cancellations less than 7 days before the departure date will be charged 90% of the booked price. 3.3 Samyna – Tour & Travel reserves the right to cancel tours or rentals due to force majeure or unforeseen circumstances. In this case, a 100% refund of the tour price will be offered. Samyna – Tour & Travel does not accept liability for any costs already incurred. 3.4 If you wish, we can also change the day of the tour if capacity allows. Please let us know ASAP so that a change can be successfully implemented.
4. Limitation of Responsibility:
4.1 Samyna – Tour & Travel acts exclusively as an intermediary for tours, transport, boat rentals, and hotels. Participation in tours and rentals is at the participant’s own risk. Samyna – Tour & Travel accepts no liability for any injury, loss, or damage incurred during participation in the activities. 4.2 Customers are required to follow all instructions given by the providers and ensure that they are physically able to participate in the chosen activity. Samyna – Tour & Travel accepts no responsibility for the absence of important personal items, damage, delays, or irregularities in the flight schedule. This also applies to minor or major accidents, including death, natural disasters, or bad weather, which could make the trip unpleasant and are beyond the control of Samyna – Tour & Travel. 4.3 Samyna – Tour & Travel is not liable for the safety of personal property during the activities. Clients are encouraged to adequately secure and monitor their personal belongings. 4.4 Samyna – Tour & Travel reserves the right to cancel tours or rentals due to force majeure, unforeseen circumstances, or safety concerns. In such cases, Samyna – Tour & Travel will make reasonable efforts to offer alternative solutions but cannot be held liable for any inconvenience or costs incurred.
5. Carrying Out the Activity:
5.1 You must arrive on time at the meeting point specified by the provider. Please also refer to the provider’s T&Cs. If you are traveling to the activity from abroad, you are responsible for the necessary travel documents (passport, visa, etc.) and compliance with health regulations, etc. 5.2 No insurance is included in the booking price of the services. You are responsible for ensuring that you have adequate insurance cover. We strongly recommend that you take out travel insurance, especially if you book an activity that involves outdoor or high-risk activities. We do not conduct tours or employ guides ourselves and do not set safety standards for activities. We work with independent companies. 5.3 Operators are independent contractors and not agents or employees of Samyna – Tour & Travel. We are not liable for the acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of suppliers or for any personal injury, property damage, or other claims for damages or expenses arising out of or otherwise resulting from any booking or activity. 5.4 Time and deadline calculations are based on the provider’s time zone.
6. Travel Insurance:
6.1 We strongly advise that you procure comprehensive insurance coverage from a reputable insurance provider in your country, encompassing Travel Insurance, Accident Insurance, or any other pertinent insurance policies. These insurance coverages are not incorporated within this travel package. Hence, it is imperative that you obtain your own insurance for the duration of your trip. 6.2 The Rinjani tour is the only tour which includes insurance per person during the tour.
- Policyholder: Gunung Rinjani National Park qq Mountain Climbing Visitors.
- Party Insured (PYD): Mountain climbing visitors who purchased an official insurance ticket from the policyholder.
- Entry Age: 10 (ten) to 70 (seventy) years old.
- Period of Insurance: From entering the entrance to exiting climbing location (Max. 4 x 24 hours).
- Overview of the maximum capacities: Rp (Indonesian Rupiah).
- We still advise you to procure extra insurance in case the coverage is not enough.
7. Categorizing Accommodations:
7.1 We categorize our lodgings into Budget, Normal Standard, and High Standard. 7.2 Budget accommodations are suitable for travelers who prioritize the experiential aspect and find basic lodging or sleeping arrangements sufficient. Budget is classified at a backpacker level and may include a double room or dormitory sleeping space. Details regarding sleeping arrangements can be found in the tour overview. 7.3 Normal Standard is designated for accommodations ranging from 3 to 4 stars or guesthouses that surpass the amenities of Budget lodgings. 7.4 High Standard is reserved for 5-star hotels or luxurious accommodations where comfort plays a pivotal role.
8. Data Protection:
8.1 Samyna – Tour & Travel collects and processes personal data in accordance with the applicable data protection regulations. Details can be found in the privacy policy on the website.
9. Image Usage and Copyright:
9.1 All images, graphics, and content used on our website are subject to the copyright of Samyna – Tour & Travel or are used with appropriate permission. 9.2 The use of images and content from Samyna – Tour & Travel is solely permitted for private purposes or for obtaining information about the offered services. Any commercial use, reproduction, or distribution without prior written consent from Samyna – Tour & Travel is prohibited. 9.3 Users uploading or sharing images on our platform agree that these images may be used by Samyna – Tour & Travel for marketing purposes, social media presence, or other company-related activities, provided. 9.4 Samyna – Tour & Travel assumes no liability for the content of images uploaded by users. Users are responsible for complying with copyright regulations. 9.5 If you believe that your copyrights have been violated, please contact us promptly at info@samyna.com with the relevant details. We will take immediate action to address the matter.
10. Refund of Used Tours and Rentals:
10.1 We appreciate your trust in our services. Ensuring that your travel experience is enjoyable is important to us. However, please note that due to the nature of our services, we do not offer refunds for tours that have already been used. If you are dissatisfied with our service, we kindly ask you to provide us with your feedback. To find a solution, we request that you describe in as much detail as possible what the issue was and to whom or what your dissatisfaction is related. This allows us to address it specifically and make improvements. Your opinion matters to us. We will carefully review your feedback. In some cases, we may offer a small discount for a future tour to ensure your satisfaction. Thank you for your understanding and cooperation.
11. Changes to the GTC:
